1. (a) A former licensee has up to one year after the expiration date of a license to renew the license by:

   1. (1) completing a license renewal application through the online portal;
   2. (2) completing 40 hours of continuing education as provided in §555.35 of this subchapter (relating to Continuing Education Requirements for License Renewal); and

   3. (3) submitting the following fee through the online portal to the Texas Health and Human Services Commission (HHSC):

      1. (A) a $375 late renewal fee for a license that has been expired for 90 days or less; or
      2. (B) a $500 late renewal fee for a license that has been expired for 91 days to 365 days.
2. (b) A former licensee whose license has been expired for more than 365 days must meet the licensure and examination requirements for an initial license.
3. (c) A former licensee must retake the NAB examination if the former licensee last took and passed the NAB examination more than five years before the completed application date.
4. (d) A person who fails to renew a license before the expiration date must not practice in the field of nursing facility administration until the license is renewed.
5. (e) HHSC imposes one or more sanctions listed in §555.57 of this chapter (relating to Schedule of Sanctions) against a person who practices with an expired license.
