Increase in Capacity

- (a) During the license term, a license holder may not increase capacity without approval from the Texas Health and Human Services Commission (HHSC). The license holder must submit to HHSC a complete application, through the online portal, for increase in capacity and the fee required in §551.19 of this subchapter (relating to License Fees).
- (b) An application for an increase in capacity that was not included in the plan approved under §533A.062 of Texas Health and Safety Code, Plan on Long-Term Care for Persons with an Intellectual Disability, will not be approved by HHSC .
- (c) Upon approval of an increase in capacity, HHSC will issue a new license.
