The purpose of this subchapter is to provide standards for jail-based competency restoration services in pilot and county-based programs, as required by the Texas Code of Criminal Procedure, Chapter 46B, relating to Incompetency to Stand Trial. The programs include:

1. (1) mental health services;
2. (2) intellectual disability services;
3. (3) co-occurring psychiatric and substance use disorder treatment services;
4. (4) competency restoration education in the county jail for an individual found incompetent to stand trial; and
5. (5) discharge planning services.
