The department shall collect a fee of $2,500 to $5,000 from each applicant who is granted a waiver of the two-year home residency requirement from the Bureau of Citizenship and Immigration Services. The Texas Conrad 30 program shall assess the fee each year based on the cost of operating the program. The amount of the application fee will be identified on the Texas Conrad 30 program website at http://www.dshs.state.tx.us/chpr/j1info.shtm by May 1 of each year. The fee shall be submitted to the department at the time of application. Part of the fees may be returned under the following circumstances:

1. (1) if the department recommends the waiver to the U.S. Department of State, none of the application fee will be returned to the applicant;
2. (2) if the applicant withdrawals the application before a recommendation is submitted by the department, 50% of the application fee will be returned to the applicant; or
3. (3) if at the time the application is received by the department, all 30 slots have been used for the fiscal year, 100% of the application fee will be returned to the applicant.
