1. (a) The board shall determine the qualifications for and employ an executive director who shall be the chief executive officer of the agency.
2. (b) The duties of the executive director shall be to administer and enforce the applicable law, to assist in conducting meetings of the board, and to carry out other responsibilities as assigned by the board.
3. (c) The executive director shall have the authority and responsibility for the operations and administration of the agency and such additional powers and duties as prescribed by the board. As chief executive of the agency, the executive director shall be responsible for the management of all aspects of administration of the agency to include personnel, financial and other resources in support of the applicable law, rules, policies, mission and strategic plan of the agency.
4. (d) The executive director may exercise any responsibilities or authority of the secretary-treasurer of the board unless the board assigns duties or prerogatives exclusively to the secretary-treasurer.
5. (e) The executive director shall serve as the medical director of the agency if the executive director is a physician licensed to practice in Texas.
