(a) The owner of a dental laboratory that was registered with the State Board of Dental Examiners September 1, 1987, is not required to submit proof that the laboratory has at least one certified dental technician employed by and working on the premises provided that:
- (1) the registration has been renewed each year and all registration fees have been paid;
- (2) the beneficial ownership of at least 51% interest in the laboratory has not been transferred; and
- (3) the owner is employed on the premises of the laboratory at least 30 hours per week.
- (b) For this section, the designated employee of the dental laboratory must be employed by and working on the premises of the dental laboratory a minimum of 30 hours per week.
