22 Tex. Admin. Code § 535.34 – Salespersons Employed by an Owner of Land and Structures Erected by the Owner

(a) Salesperson employed by an owner means a person employed and directly compensated by an owner.
(b) Salesperson employed by an owner does not include:
1. (1) a real estate licensee who lists, orally or in writing, an owner's property for sale;
2. (2) any person employed by, associated with, cooperating with, or sponsored by a real estate licensee who lists, orally or in writing, an owner's property for sale; or
3. (3) any person who, having no preexisting employment or listing agreement with an owner, sells or attempts to sell an owner's property.
