22 Tex. Admin. Code § 535.32
A power of attorney which is recorded in the county in which the particular real property is located and which specifically describes the real property to be sold authorizes a person to act as a real estate agent for the owner of such property without the necessity of real estate licensure. An unlicensed person cannot use the power of attorney method to engage in the real estate agency business.
