The board's staff, board members, committee members, or Enforcement Advisory Committee members may transmit a previously issued opinion to any person with a cover letter clearly identifying that the opinion is advisory in nature, is restricted to the fact situation identified in the opinion, and is not binding until ratified by the board at a regularly scheduled board meeting. A copy of the transmittal letter and the opinion transmitted shall be forwarded to the board.
