1. (a) The board may require a Federal Bureau of Investigation criminal history records background check on applicants to become licensed, registered, or certified in Texas at any stage in the application process.
2. (b) Applicants required to provide the Federal Bureau of Investigation criminal history records background check will be responsible for the cost of searching the database.
3. (c) Applicants will be provided with information on how to obtain the Federal Bureau of Investigation criminal history records background check through the Texas Department of Public Safety, and the Texas Department of Public Safety will provide the records directly to the board.
4. (d) Criminal history record information obtained from the Texas Department of Public Safety and/or the Federal Bureau of Investigation will be maintained pursuant to §411.084 of the Texas Government Code in order to protect the confidentiality of the information.
