- (a) The executive director is delegated authority to issue subpoenas authorized by the Administrative Procedure Act in contested cases and the Public Accountancy Act.
- (b) A party may obtain discovery of the identity and location (name, address, and telephone number) of an expert who may be called as an expert witness, the subject matter on which the expert is expected to testify, the mental impressions and opinions held by the expert and the facts known to the expert (regardless of when the factual information was acquired) which related to or form the basis of the mental impressions and opinions held by the expert. Provided, however, that under no circumstances may the respondent resist discovery in any action by the board on the grounds that the respondent as a licensee may testify as an expert.
