1. (a) Members of the board, the executive director, members of board staff, and independent contractors retained by the board shall not disclose any confidential information which comes to their attention, except as may be required by law.

2. (b) All complaints, investigation files, investigation reports, and other investigative information in the possession of, received or gathered by the board is confidential and any employee, agent, or member of the board may not disclose the information contained in these files except under the following circumstances:

   1. (1) to another state, local or federal governmental or regulatory enforcement agency if sought in the furtherance of an investigation by the requesting agency in an enforcement action regarding the licensee; and
   2. (2) to appropriate law enforcement agencies if sought in the furtherance of a criminal investigation by the requesting agency.
