1. (a) The Board may take disciplinary actions as specified in chapter 365 of these rules (relating to Licensing) in the event of any violation of any of these requirements.

2. (b) A person commits a Class C misdemeanor by:

   1. (1) Violating the act or the rules adopted under it;
   2. (2) Performing non-exempt plumbing work without holding a valid license or endorsement issued through the Board;
   3. (3) Employing an unlicensed individual to perform activities that by law require the skills and supervision of a licensed plumber without providing for that unlicensed individual's supervision as specified by Section 367.3 of this title (relating to requirement for plumbing companies).

   4. (4) Proclaiming through advertising or by producing another's plumbing license or license number or by other means claiming that:

      1. (A) a person is a licensed plumber when in fact that person is not a plumber licensed by the Board, or
      2. (B) that a person or plumbing company has secured the services of a Responsible Master Plumber as specified in Section 367.3 of this title, when in fact that company has not;
   5. (5) Acting, serving, or representing oneself as a Plumbing Inspector, or conducting plumbing inspections as defined in the Act and Board Rules without holding a valid Plumbing Inspector License and without being employed by, or an agent of a political subdivision.
3. (c) A person who violates any provision of the act or these rules or any other order of the Board is subject to a penalty of not less than $50 or more than $1,000 for each violation and for each day of violation after notification.
