Transfer of Licenses Prohibited

- (a) No license issued under the provisions of Texas Occupation Code 651.351, is transferable as to ownership or location.
- (b) If a funeral establishment changes ownership, it must obtain a new establishment license by reporting the change on a commission form that must be filed with the commission within 30 days of the date of the change and must be accompanied by a fee established by the commission and copies of all required price lists, purchase agreements, and embalming case report forms to reflect change of new ownership. The executive director may require the funeral establishment to pass an inspection by a commission representative before approval of a new license under this rule.
- (c) The funeral establishment may continue to operate under its current license until it has been either issued a new license or notified that a license has been refused because of a failure to meet the requirements of subsection (b) of this section or under the provisions of Texas Occupation Code 651.351. An establishment shall be deemed as notified once written notice has been placed in the regular United States mail to the physical address of the fixed place of the physical plant.
- (d) A change of establishment name or fixed place requires the issuance of a new establishment license.
