1. (a) A person is not eligible to serve on a state review panel if, during the three years immediately preceding the appointment, the person:

   1. (1) was employed by or received funds from any individual or entity in any way affiliated with a publishing company or participating in an adoption under which the state or a state review panel will evaluate instructional materials; or
   2. (2) owned or controlled, directly or indirectly, any interest in a publishing company or an entity receiving funds from a publishing company.
2. (b) For the purposes of this section, an eligible institution under §66.67 of this title (relating to Adoption of Open-Source Instructional Materials) that has submitted open-source materials for adoption is considered to be an entity participating in an adoption.
