To be eligible to receive a scholarship under this subchapter, a student must:

1. (1) be a resident of Texas, as defined in §22.1 of this chapter (relating to Definitions);
2. (2) provide proof to the Texas institution that he or she has been offered a non-athletic scholarship or grant, including an offer of payment of tuition, fees, room and board, or a stipend, by an out-of-state institution; and
3. (3) have been accepted for admission to the out-of-state institution offering the assistance.
