The following words and terms, when used in this subchapter, shall have the following meanings unless the context clearly indicates otherwise.

1. (1) Administrative Law Judge -- The person appointed by the Chief Administrative Law Judge of the State Office of Hearings and Appeals (SOAH) under Section 2003.041 of the Texas Government Code.
2. (2) Board --The Texas Higher Education Coordinating Board.
3. (3) Commissioner -- The Commissioner of Higher Education.
4. (4) Contested Case -- A proceeding in which the legal rights, duties, or privileges of a party are to be determined by the board after an opportunity for adjudicative hearing.
5. (5) Party -- Each person or agency named or admitted as a party to a hearing.
