An individual may not offer or provide instruction in motorcycle operation to the public for consideration unless the individual:

1. (1) holds an instructor license issued by the department;
2. (2) provides the instruction in accordance with a curriculum approved by the department; and
3. (3) provides the instruction as an employee of, or under contract with, a motorcycle school.
