- (a) Air conditioning and refrigeration contracting performed by a regular employee of a regulated electric or gas utility is exempt if it is performed in connection with the utility business in which the person is employed.
- (b) The Act does not apply to an individual who performs air conditioning and refrigeration maintenance work on equipment owned by him on property owned by him if he does not engage in the occupation of air conditioning and refrigeration contracting for the general public. This exemption applies only to the owner and not to others who may attempt to assist the owner.
(c) The Act does not apply to those who hold a valid Certificate of Authorization issued by the American Society of Mechanical Engineers or the National Board of Boiler and Pressure Vessel Inspectors that is:
- (1) appropriate for the scope of work to be performed; and
- (2) performed solely on boilers as defined in the Health and Safety Code, Title 9, Subtitle A, Chapter 755, Boilers.
