This chapter does not apply to:

1. (1) buildings owned and operated by the federal government;
2. (2) equipment regulated by a municipal inspection and certification program approved under §74.65(b);

3. (3) the following structures if access is limited primarily to employees:

   1. (A) equipment in an industrial facility;
   2. (B) grain silos;
   3. (C) radio antennas;
   4. (D) bridge towers;
   5. (E) underground facilities; and
   6. (F) dams;
4. (4) equipment located in a private building of less than three stories that is used exclusively by a labor union, trade association, private club, or charitable organization; and
5. (5) elevators located in a single family dwelling except as provided by Texas Health and Safety Code, §754.0141.
