1. (a) The department may delegate its statutory authority and responsibilities regarding examinations via contract to a third-party examination provider (department's examination provider). The department's examination provider, who is contracted to act on behalf of the department, must comply with all statutes and rules applicable to the department and to state agencies regarding examinations.
2. (b) The department's examination provider may administer an examination for those license types that require a person to pass an examination in order to obtain a license. The statutes and rules for a specific program determine what examination, if any, is required.
3. (c) The department's examination provider is the point of contact regarding examination matters, including examination scheduling, rescheduling, refunds, accommodations, and results, as prescribed by the rules in this subchapter and the statutes and rules for a specific program.
4. (d) The provisions in this subchapter apply to all programs regulated by the department, except in the event of a conflict with the statute and rules of a specific program.
