1. (a) The board may order a licensee to pay a refund to a patient as part of an agreement resulting from an informal settlement conference.
2. (b) The refund may be used instead of or in addition to an administrative penalty imposed by the board.
3. (c) The amount of the refund agreed to in the agreed order may not exceed the charges for the services rendered by the licensee.
4. (d) The refund order is limited to the amount that the patient paid for services rendered by the licensee and cannot require payment for other damages or estimate of harm.
