The Commissioners or the Hearings Director may dismiss, with or without prejudice, any proceeding under such conditions and for such reasons as are found to be just and reasonable, including the following:

1. (1) failure to prosecute;
2. (2) unnecessary duplication of proceedings or res judicata;
3. (3) withdrawal;
4. (4) moot questions or obsolete petitions;
5. (5) lack of jurisdiction; or
6. (6) if necessary in the interest of justice.
