- (a) Prior to the final adoption of any rule, the commission shall give at least 30 days' notice of the proposed rulemaking. Notice of the proposed rule shall be filed with the secretary of state and published in the Texas Register. This section shall not limit the commission's power to adopt emergency rules as set forth in the Administrative Procedure and Texas Register Act (APTRA).
- (b) In all rulemaking proceedings, the commission shall give notice according to the procedures set forth in APTRA.
