As used in this subchapter:

1. (1) CAA--Community Action Agency.
2. (2) Children--households with dependents not exceeding 18 years of age.
3. (3) Department (the)--the Texas Department of Housing and Community Affairs
4. (4) DOE--the United States Department of Energy.
5. (5) Dwelling Unit--a house, including a stationary mobile home, an apartment, a group of rooms, or a single room occupied as separate living quarters.
6. (6) EASY--the Department of Energy approved audit software used to determine the cost effectiveness of weatherization measures to be installed on a dwelling unit.
7. (7) Elderly Person--a person who is 60 years of age or older.
8. (8) Electric base-load measure--weatherization measures which address the energy efficiency and energy usage of lighting and appliances.
9. (9) Families with young children--a family unit that includes a child not exceeding 6 years of age.
10. (10) High energy burden--is determined by dividing annual home energy costs by annual gross income. The percentage at which energy burden is considered high is defined by data gathered from the State Data Center and updated each year.
11. (11) High energy consumption--the household energy consumption exceeding the data collected from the State Data Center and updated each year.
12. (12) Household--all persons living together in a dwelling unit.
13. (13) Local units of Government--city, county, or council of governments.

14. (14) Low Income--that income in relation to family size which:

    1. (A) Is at or below 125 percent of the poverty level determined in accordance with criteria established by the Director of the Office of Management and Budget;
    2. (B) Is the basis on which cash assistance payments have been paid during the preceding twelve month-period under titles IV and XVI of the Social Security Act or applicable State or local law; or
    3. (C) If a State elects, is the basis for eligibility for assistance under the Low Income Home Energy Assistance Act of 1981, provided that such basis is at least 125 percent of the poverty level determined in accordance with criteria established by the Director of the Office of Management and Budget.
15. (15) Multifamily Dwelling Unit--a structure containing more than one dwelling unit.

16. (16) Persons with Disabilities--any individual who is:

    1. (A) a handicapped individual as defined in §7(6) of the Rehabilitation Act of 1973;
    2. (B) under a disability as defined in §1614(a)(3)(A) or §223(d)(1) of the Social Security Act or in §102(7) of the Developmental Disabilities Services and Facilities Construction Act; or
    3. (C) receiving benefits under chapter 11 or 15 of title 38, U.S.C.
17. (17) Rental Unit--a dwelling unit occupied by a person who pays rent for the use of the dwelling unit.
18. (18) Single-Family Dwelling Unit--a structure containing no more than one dwelling unit.
19. (19) State--the State of Texas.
20. (20) Subrecipient--an entity managing a weatherization project which receives a grant of funds awarded.
21. (21) 10 CFR 440--the Code of Federal Regulation describing the Weatherization Assistance for Low Income Persons as administered through the Department of Energy.
22. (22) WAP--Weatherization Assistance Program.
23. (23) Weatherization Material--the material listed in Appendix A of 10 CFR 440.
24. (24) Weatherization Project--a project conducted in a single geographical area which undertakes to weatherize dwelling units that are energy inefficient.
