Each grant application must include a resolution from the county commissioners' court that contains the following:

1. (1) authorization for the submission of the application to the Commission;
2. (2) provision giving the authorized official the power to apply for, accept, decline, modify, or cancel the grant; and
3. (3) written assurance that, in the event of loss or misuse of Fair Defense Account funds, the governing body will return all funds as required by the Commission.
