1 Tex. Admin. Code § 93.94
When the manner of use of the trademark or service mark prevents the applicant from providing specimens, the applicant may provide two copies of a suitable photograph. The photograph should be no larger than 8 1/2 inches by 11 inches. The photograph should clearly show the mark and the item on which it is used. Black and white matte finish photographs are most suitable for permanent microfilm reproduction.
