1 Tex. Admin. Code § 61.505
Pursuant to Tex. Code Crim. Proc. Art. 56.34, if circumstances require that the victim or claimant personally pay a medical expense incurred as a direct result of criminally injurious conduct, the OAG will award compensation to the victim or claimant for the amount not compensated by a collateral source. If an insurance company pays the medical bill, the unpaid balance of said bill is determined to be the victim's or claimant's pecuniary loss and payment shall not exceed the allowable amount for that service under the Texas Workers' Compensation Commission medical fee guidelines.
