1 Tex. Admin. Code § 53.19
"Then current conditions," as used in Texas Civil Statutes, Article 717k-3, §5, is construed to mean, without limitation, the actual market value of real, personal, and mixed properties on the tax rolls of the issuer, in cases of general obligation partial refundings, at the time of the partial refunding, and the outstanding debt of the issuer, the types of properties enrolled, ratios of value between the different types of properties, the age and condition of the properties of principal taxpayers of the issuer, the outstanding nontax revenue-funded obligations of the issuer in cases of such revenue obligation partial refundings, the condition of such revenue-producing plant, the current market for the services or products of such revenue-producing plant, and allied factors.
