1. (a) This subchapter applies to an HHSC contract dispute that is subject to Chapter 2260, Texas Government Code.
2. (b) This subchapter does not apply to an action of HHSC for which a contractor is entitled to a specific remedy pursuant to state or federal constitution or statute.
3. (c) This subchapter does not apply to a contract action proposed or taken by HHSC for a contractor receiving Medicaid funds under a contract that is entitled by state statute or rule to a hearing conducted in accordance with the Texas Government Code Chapter 2001.
