What is the legal basis for this chapter's assistance programs?

(a) For the TANF Program, the federal law basis is:
- (1) the Personal Responsibility and Work Opportunity Reconciliation Act of 1996, codified in Title IV of the Social Security Act (42 U.S.C. §601 et seq.); and
- (2) the federal regulations in 45 CFR, Parts 260 through 265.
(b) For the TANF Program, the state law basis is:
- (1) the Texas Human Resources Code, Chapter 31, which authorizes DHS to administer the TANF Program in Texas;
- (2) the Texas Human Resources Code, Chapter 34, which authorizes DHS to administer the TANF State Program; and
- (3) the rules of this chapter, as well as other applicable DHS rules.
(c) For the Food Stamp Program, the federal law basis is:
- (1) the Food Stamp Act of 1977 (7 U.S.C. §2011 et seq.); and
- (2) the federal regulations in 7 CFR, Part 273. By this rule, to the extent these regulations impose federal mandates that apply to Texas, DHS incorporates these regulations by reference for administration of the Food Stamp Program in Texas. If these regulations provide options from which Texas may choose or if Texas is granted a waiver from a federal mandate, the rules of this chapter and other applicable state administrative rules and policy describe the options Texas has chosen and the waivers Texas has been granted.
(d) For the Food Stamp Program, the state law basis is:
- (1) the Texas Human Resources Code, Chapter 33, which authorizes DHS to administer the Food Stamp Program in Texas; and
- (2) the rules of this chapter, as well as other applicable DHS rules.
