1. (a) The hearing official will determine the location of the hearing or whether it is appropriate to conduct the hearing by telecommunication as provided in §357.15 of this chapter (relating to Telecommunication). In making this determination, the hearing official will consider the location of the individual.

2. (b) Accommodations.

   1. (1) The operating agency will provide:

      1. (A) any reasonable accommodation for disclosed disabilities;
      2. (B) suitable interpretation for individuals with limited English proficiency.

   2. (2) Requests for any reasonable accommodation and requests for an interpreter shall be made to the hearing official as follows:

      1. (A) for a standard fair hearing--in writing, at least 3 days prior to the hearing; and
      2. (B) for an expedited fair hearing--at the time the individual is notified of the expedited fair hearing.
