1. (a) Upon completion of the investigation and final disposition of any administrative, civil, or criminal action taken by the state or federal government, the Health and Human Service Commission-Office of Inspector General (HHSC-OIG) will determine and direct the collection of any overpayment.
2. (b) Overpayments collected as a result of an investigation will be distributed to the Managed Care Organization (MCO) unless HHSC-OIG determines that an alternative distribution is indicated.
3. (c) If the HHSC-OIG determines that an MCO is not entitled to all or any portion of the distribution of funds collected as a result of an overpayment then HHSC-OIG will provide the MCO with a written explanation indicating the rationale for the alternative distribution of funds.
