This subchapter does not apply to:

1. (1) vessels with a valid marine document issued by the United States Coast Guard's National Vessel Documentation Center or a federal agency that is a successor to the National Vessel Documentation Center; or

2. (2) an outboard motor that:

   1. (A) is at least 40 years of age; and
   2. (B) has a capacity of not more than 25 horsepower.
