1. (a) Before denying an application for a license, the commission or executive director shall:

   1. (1) set the matter for a hearing to be conducted by the State Office of Administrative Hearings; and

   2. (2) before the hearing date, notify the applicant in writing of:

      1. (A) the charges alleged or the question to be determined at the hearing; and
      2. (B) the date and location of the hearing.

2. (b) At a hearing under this section, the applicant may:

   1. (1) be present and be heard in person or by counsel; and
   2. (2) have an opportunity to offer evidence by oral testimony, affidavit, or deposition.
3. (c) Written notice may be served by personal delivery to the applicant or by certified mail to the last known mailing address of the applicant.
