1. (a) As required to fulfill the department's objectives under this chapter, the department is entitled to access to the files and records of:

   1. (1) the commission;
   2. (2) the Texas Workforce Commission;
   3. (3) the Texas Department of Human Services;
   4. (4) the State Office of Risk Management; and
   5. (5) other state agencies.
2. (b) A state agency shall assist and cooperate in providing information to the department.
3. (c) Information that is confidential under state law is accessible to the department under rules of confidentiality and remains confidential.
4. (d) The identity of an individual or entity selected to participate in a department survey or who participates in such a survey is confidential and is not subject to public disclosure under Chapter 552, Government Code.
