In this chapter:

1. (1) "Commissioner" means the commissioner of aging and disability services.
2. (2) "Department" means the Department of Aging and Disability Services.

3. (3) "Employee" means a person who:

   1. (A) works at a facility;
   2. (B) is an individual who provides personal care services, active treatment, or any other personal services to a resident or consumer of the facility; and
   3. (C) is not licensed by an agency of the state to perform the services the employee performs at the facility or is a nurse aide employed by a facility.
4. (3-a) "Executive commissioner" means the executive commissioner of the Health and Human Services Commission.

5. (4) "Facility" means:

   1. (A) a facility:

      1. (i) licensed by the department; or
      2. (ii) licensed under Chapter 252;
   2. (B) an adult foster care provider that contracts with the department;
   3. (C) a home and community support services agency licensed by the department under Chapter 142; or
   4. (D) a prescribed pediatric extended care center licensed under Chapter 248A.

6. (5) "Reportable conduct" includes:

   1. (A) abuse or neglect that causes or may cause death or harm to a resident or consumer of a facility;
   2. (B) sexual abuse of a resident or consumer of a facility;
   3. (C) financial exploitation of a resident or consumer of a facility in an amount of $25 or more; and
   4. (D) emotional, verbal, or psychological abuse that causes harm to a resident or consumer of a facility.
