1. (a) The executive commissioner and the attorney general shall adopt by rule a memorandum of understanding that:

   1. (1) defines the department's and the attorney general's responsibilities concerning assisted living facilities;
   2. (2) outlines and coordinates procedures to be used by those agencies in responding to complaints concerning assisted living facilities; and
   3. (3) provides a plan for correcting violations or deficiencies in assisted living facilities.
2. (b) The department shall prepare the initial draft of the memorandum of understanding and shall facilitate and ensure its adoption.
