In this chapter:

1. (1) "Commission" means the Health and Human Services Commission.
2. (2) "Department" means the Department of Assistive and Rehabilitative Services.

3. (3) "Developmental delay" means a significant variation in normal development as measured by appropriate diagnostic instruments and procedures, in one or more of the following areas:

   1. (A) cognitive development;
   2. (B) physical development;
   3. (C) communication development;
   4. (D) social or emotional development; or
   5. (E) adaptive development.
4. (4) "Executive commissioner" means the executive commissioner of the Health and Human Services Commission.
