1. (a) This chapter does not apply to an institution of higher education as defined by Section 61.003, Education Code.

2. (b) This chapter does not apply to contracts of the Texas Department of Transportation that:

   1. (1) relate to highway construction or highway engineering; or
   2. (2) are subject to Section 201.112, Transportation Code.
