- (a) The governor shall appoint a board member to fill a vacancy under the same procedure that applied to the original appointment for that position.
- (b) If the presiding officer's position is vacant, the executive director shall perform nonvoting duties of the presiding officer until the governor designates a new presiding officer.
- (c) If the final result of an action brought in a court of competent jurisdiction is that a board member may not serve on the board under the Texas Constitution, the governor shall appoint a replacement who may serve.
