1. (a) An authorized representative of the Department of Family and Protective Services may assume the care, control, and custody of a child:

   1. (1) who is abandoned without identification or a means for identifying the child; and
   2. (2) whose identity cannot be ascertained by the exercise of reasonable diligence.
2. (b) The department shall immediately file a suit to terminate the parent-child relationship of a child under Subsection (a).
