1. (a) Not later than January 1, 2006, each polling place must provide at least one voting station that:

   1. (1) complies with Section 504 of the federal Rehabilitation Act of 1973 (29 U.S.C. Section 794) and its subsequent amendments and Title II of the federal Americans with Disabilities Act (42 U.S.C. Section 12131 et seq.) and its subsequent amendments; and
   2. (2) provides a practical and effective means for voters with physical disabilities to cast a secret ballot.
2. (b) Subsection (a) applies only to a polling place that uses an electronic voting system unless the secretary of state certifies that federal law requires the application of Subsection (a) to all forms of voting at a polling place.
3. (c) The requirement imposed by Subsection (a) does not apply to an election of trustees of an independent school district, other than an election of an independent school district that is held jointly with another election in which a federal office appears on the ballot, held before January 1, 2008. This subsection expires January 1, 2008.
