The specimen must demonstrate the mark serving as a source indicator for the identified services. Therefore, registration must be refused if the specimen shows the mark is used only to promote goods rather than the identified services, or the mark is not used as a service mark for the identified services, even if the specimen shows use of the mark as a service mark for other services (i.e., the applicant misidentified the services). See In re Weiss, Ser. No. 88621608, 2024 TTAB LEXIS 277, at *21 (2024) (applicant’s specimen was not acceptable because it showed use of the proposed mark for cooking and food-related products for sale by third parties on their websites and did not show use for the identified services, online retail store services); TMEP §§1301.02(a), 1301.02(e)–1301.02(f).
