All railroad track and platform scales which are used in connection with shipping are hereby placed under the jurisdiction of the Public Service Commission for inspection and it may require the installation or replacement of scales when needed. A failure or refusal to carry out the instructions of the Commission in reference to such scales shall be punished by a penalty of two hundred dollars for each refusal to be recovered by suit in any court of competent jurisdiction by any person aggrieved. Any sum so recovered shall be turned into the State Treasury for general use.
