Every officer, agent or employee of any railroad company who shall wilfully neglect or refuse to make and furnish any report required by the Commission as necessary to the purposes of this chapter or who shall wilfully and unlawfully hinder, delay or obstruct the Commission in the discharge of the duties imposed upon it shall forfeit and pay a sum of not less than one hundred dollars nor more than one thousand dollars for each offense, to be recovered in any action in the name of the State as provided in Section 58-17-3940.
