S.C. Code Ann. § 49-4-180 – Violation of chapter; penalties

(A) A surface water withdrawer who commits a violation of this chapter:
1. (1) is subject to a civil penalty of not more than ten thousand dollars for each day that the violation occurred; or
2. (2) is guilty of a misdemeanor and, upon conviction, must be fined not more than ten thousand dollars for each day that the violation occurred, if the violation is wilful.
(B) All penalties and fines assessed and collected pursuant to this chapter must be deposited in the general fund of the State.

2010 Act No. 247, Section 4.B, provides:

"Chapter 1, Title 49 of the 1976 Code is not affected by and supersedes Chapter 4, Title 49 of the 1976 Code, as amended by SECTION 1 of this act."

Effect of Amendment

The 2010 amendment rewrote the section.
