(a) Persons authorized by Section 44-53-930 making sales to persons who are personally known by them and who are known to have a legitimate medical or veterinary medicine use for such syringes or needles and who deliver such syringes or needles to the domicile of the buyer are not required to obtain the signature of the buyer provided that the name of the person shall be inserted in the record of sale and initiated by the person authorized by Section 44-53-930 approving the sale.
(b) Sales made to inpatients of hospitals, nursing homes, or other extended-care facilities which involve the delivery of hypodermic needles or syringes to a person other than the consumer shall not be deemed a retail sale; provided, that such delivery is made to an authorized agent of a health facility otherwise licensed by the Department of Health and Environmental Control, and that a record of the quantity furnished to the facility is maintained.
