[Until January 1, 2008, this section reads as follows:]

1. (A) It is unlawful for a person, directly or indirectly, to engage in or conduct the business of, or to advertise or hold himself out as engaging in or conducting the business of, or to act in the capacity of, an appraiser within this State without first obtaining a permit, license, or certification as provided in this chapter.
2. (B) A person acting as an appraiser within the meaning of this chapter without a permit, license, or certification is guilty of a misdemeanor and, upon conviction, must be fined not more than five hundred dollars or imprisoned not more than six months, or both.

3. (C) An appraiser who fails to renew a license or certification and who continues to engage in appraisal activities or business is guilty of a misdemeanor and, upon conviction, must be fined not more than five hundred dollars or imprisoned not more than six months, or both.

   [From and after January 1, 2008, this section is named "Civil action for injunctive relief; fines" and reads as follows:]

   The department, in addition to instituting a criminal proceeding, may institute a civil action through the Administrative Law Court, in the name of the State, for injunctive relief against a person or entity violating this chapter, a regulation promulgated under this chapter, or an order of the board. For each violation the administrative law judge may impose a fine of not more than ten thousand dollars.
