Temporary order for payment of child support pending determination of parentage

The court shall issue, upon motion of either party, a temporary order requiring the payment of child support pending an administrative or judicial determination of parentage if:

  1. (1) the defendant has signed a verified voluntary acknowledgment of paternity which complies with the requirements of Section 20-7-956(A)(4);
  2. (2) the defendant has been determined pursuant to law to be the parent; or
  3. (3) there is other clear and convincing evidence that the defendant is the child's parent.
